JUDICIAL REVIEW

GWP have instigated a Judicial Review because the Scottish Government overturned the Reporters recommendation to refuse consent. These are the details:

After talking to our legal team we decided to appoint James Findlay K.C., one of  Scotlands most eminent environmental/planning advocates, to give an opinion regarding the chances of a successful appeal. This was done and, after careful consideration, we decided to go ahead.

This is the timetable that we have to date and the dates for the hearing will be set on 14th July. We will be lodging the grounds of appeal by 12th May.

Timetable

GWP raised £52,000 from the local community for the public inquiry and the judicial review and we now need to raise another £30,000.

This is a very important case in Scottish law and would have great repercussions if we won. The Public Inquiry which lasted over 6 weeks was extremely thorough, the Reporters recommended rejection of the KTR application and then the Scottish Ministers overturned it. It is in so many peoples interest that we win this case and then future court cases will be able to cite GWP v ScMinisters as a case reference.

We are hoping that other community action groups involved with pylons and renewables will be able to donate to this case.
